1. Introduction and Agreement

These Terms and Conditions outline the rules and regulations for the use of Mudify Corp's Website, located at 19790 W Dixie Hwy, Ste 605. Miami, FL 33180. By accessing this website, we assume you accept these terms and conditions in full. Do not continue to use Mudify if you do not agree to all of the terms and conditions stated on this page.

 

2. Definitions

  • "Company," "We," "Us," or "Our": Refers to Mudify Corp, a Florida-based company located at 19790 W Dixie Hwy, Suite 605, Miami, FL 33180.

  • "Client," "You," or "Your": Refers to the person logging on to this website and compliant with the Company’s terms.

  • "Service": Refers to the Website and the products sold herein.

 

3. Intellectual Property & License

Unless otherwise stated, Mudify Corp and/or its licensors own the intellectual property rights for all material on Mudify. All intellectual property rights are reserved.

  • Restrictions: You must not republish, sell, rent, sub-license, reproduce, duplicate, or redistribute material from Mudify for commercial purposes without our express written consent.

 

4. Cookies & Tracking

We employ the use of cookies to retrieve user details for each visit and enable site functionality. By accessing Mudify, you agree to the use of cookies in accordance with our Privacy Policy.

 

5. Hyperlinking & iFrames

  • iFrames: Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.

  • Removal of links: We reserve the right to request that you remove all links or any particular link to our Website. We will consider requests to remove offensive links but are not obligated to do so or to respond directly.

 

6. Order Acceptance and Pricing

Mudify reserves the right to correct any errors, inaccuracies, or omissions—including after an order has been submitted.

  • Contract Formation: The receipt of an order confirmation does not constitute the acceptance of an order or a contract of sale. The contract is only finalized upon the shipment of the product.

  • Cancellation Rights: We reserve the right to cancel or refuse any order placed based on incorrect pricing or availability. If an error occurs, you will be notified and given the option to confirm the order at the correct price.

 

7. Return Policy & Restocking Fees

Returns, Exchanges, and Administrative Fees: All returns and exchanges are governed by our standalone Return Policy, which is hereby incorporated into these Terms by reference. By completing a purchase, you expressly agree to the terms set forth therein, including, but not limited to:

  • The 45-day eligibility window for unused items in original packaging

  • The mandatory 15% restocking administrative fee applied to all qualified returns

  • The customer’s sole responsibility for all original and return shipping costs and insurance. Mudify Corp reserves the right to refuse any return that does not strictly adhere to the documentation and condition requirements outlined in the Return Policy.

 

8. Shipping, Risk of Loss, and Delivery

All purchases of physical items from Mudify are made pursuant to a shipment contract.

  • FOB Shipping Point: This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (e.g., FedEx, UPS, DHL).

  • Carrier Liability: Mudify is not responsible for carrier delays or damages once an order has shipped.

  • International Sales: Mudify currently operates in the United States and is expanding throughout Latin America. We do not target the European Union, Canada, or Australia at this time.

 

9. Specialized Disclaimers for Automotive Parts

To the maximum extent permitted by law, we exclude all representations and warranties relating to the products sold.

  • Professional Installation Required: Many products sold by Mudify, including suspension lift kits (e.g., Bilstein, Old Man Emu), are technical in nature. We strongly recommend and require professional installation by a certified mechanic to ensure safety. Mudify shall not be held liable for any death, personal injury, property damage, or mechanical failure resulting from improper installation, modification, or misuse of products by the Client or any third party.

  • Aftermarket Modifications and Vehicle Warranty: You acknowledge that the installation of aftermarket suspension components or other modifications may affect your vehicle's factory warranty, handling characteristics, and compliance with local road safety regulations. Mudify Corp does not guarantee that the use of these products is compliant with the specific vehicle manufacturer's warranty terms or all state-specific vehicle equipment laws. It is your sole responsibility to verify with your vehicle manufacturer and local authorities how these modifications may impact your warranty coverage or road legality. Mudify Corp shall not be held liable for any voided warranties, denied dealership service, or regulatory fines resulting from the use or installation of products purchased through the Service.

  • Manufacturer’s Warranty: Mudify serves as a distributor. All products are subject only to the original Manufacturer’s Warranty. Mudify provides no additional warranties beyond those provided by the manufacturer.

 

10. Identity Verification (Real ID)

To ensure security and prevent fraud, we may require an ID verification process.

  • Security: If flagged, customers must submit a government-issued ID through our secure portal provided by Real ID. All information is encrypted and strictly confidential.

  • Data Privacy: Mudify does not store these documents on its local servers. In accordance with your Right to be Forgotten, you may request the deletion of this data at any time. Otherwise, IDs are automatically erased 30 days after the transaction is successfully verified and cleared, minimizing our data retention footprint.

 

11. Site Changes & Corrections

Mudify reserves the right to change or discontinue the Site, any Services, or products with or without notice.

  • Inaccuracies: We reserve the right to correct any errors, inaccuracies, or omissions (including pricing or availability) at any time without prior notice, even after an order has been submitted.

 

12. Accessibility Commitment (ADA Compliance)

Mudify is committed to providing a website accessible to the broadest possible audience.

  • Standards: We aim to adhere to the WCAG 2.2 AA level standards.

13. Mudify Package Protection

This is an optional service offered by Mudify. By opting into our Shipping Guarantee at checkout, Mudify agrees to assume the risk of loss or damage during transit, overriding our standard FOB Shipping Point terms. 

  • Claims: For any issues regarding lost or damaged packages protected by this service, please contact crew@mudify.com within 7 days of the delivery date to initiate the replacement or refund protocol. This service is not an insurance policy, but a contractual assumption of shipping risk by Mudify.

 

14. Membership and Promotions

  • Invite-Only Membership: Participation in Mudify’s membership program is by invitation only. Benefits, including but not limited to the 5% non-combinable discount, priority support, and complimentary package protection, are discretionary and subject to the specific rules of the program. Mudify Corp reserves the right to suspend or terminate any membership at our sole discretion, particularly in cases of policy abuse or violation of these Terms.

  • Promotional Terms: From time to time, the Company may offer promotional codes, seasonal sales, or limited-time offers. All such promotions are subject to these Terms and any specific 'Promotion Rules' published on the specific offer page or our dedicated Promotions Center.

  • General Restrictions: Unless explicitly stated otherwise:

    • Promotions cannot be combined with other offers

    • Discounts have no cash value and are non-transferable

    • Mudify Corp reserves the right to modify, extend, or terminate any promotion at any time without prior notice.

  • Conflict of Terms: In the event of a conflict between these General Terms and the specific rules of a promotion, the specific promotion rules shall prevail solely concerning that specific offer.

 

15. Dispute Resolution: Mandatory Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

  • Mandatory Arbitration: Any dispute or claim relating to your use of Mudify or products sold by us will be resolved by binding arbitration, rather than in court. This arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

  • Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

 

16. Governing Law

These terms and conditions, and any dispute arising from them, shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. All legal actions must be filed within the jurisdiction of Florida.

 

17. Indemnification

You agree to indemnify, defend, and hold harmless Mudify Corp, its officers, directors, employees, and suppliers from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your improper installation or misuse of any product purchased from Mudify.

 

18. Force Majeure

Mudify Corp shall not be liable for any failure or delay in performance under these Terms (including shipping delays) due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, carrier strikes, customs delays, supply chain disruptions, or government restrictions.

 

19. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms and Conditions unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

 

20. Copyright Infringement & DMCA Notice

If you believe that any content on the Site infringes upon your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing:

  • A physical or electronic signature of the owner

  • Identification of the copyrighted work

  • Identification of the infringing material.
